The terms and conditions mentioned herein are in accordance with the provisions defined under sub-clause (w) of Section 2 of the Information Technology Act, 2000 (IT Act) & Rule 3 (1) (Due diligence by an intermediary) of the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021.

Using Byoli implies that you agree with our terms and conditions and are legally bound by its rules and regulations. If you do not wish to be bound by these terms and conditions, then you must refrain from using this website and its services.

Definition:

The term “Member(s)”, “You” & “User(s)” shall refer to the end user accessing the website and its services.
The term “Registrant” shall refer to any person using the services on behalf of the prospective bride/groom, such as father, mother, brother, sister, relative or friend.
The term “Service(s)” refers to all the collective services offered by Byoli.com which is a subsidiary of Hostcob Solutions Private Limited, a private limited company incorporated under the Companies Act, 2013 with its registered office at JN Plaza, Haridwar Road, Near Prince Chowk, Dehradun 248001, Uttarakhand.
The term “Our”, “Byoli”, “Website” & “Platform” shall all refer to Byoli.com

Acceptance:

You acknowledge that in order to use the service(s) offered by Byoli, you must register on the website that acts as an "Intermediary" as defined under clause (1) sub-clause (w) of Section 2 of the Information Technology Act, 2000.
By registering yourself on Byoli, you consent to submit your personally identifiable information such as photo identity proof, address proof, contact details, payment information etc, and to use the said information for the purposes of providing our services.
If you no longer wish to give your consent or have any objection to the use of your personal information, you must immediately discontinue using our services and contact us regarding the same.

Eligibility:

You must be of legally competent age in order to avail the services offered by Byoli, i.e. 18 years or above for females and 21 years or above for males.
By using Byoli you confirm and warrant that you are at legal capacity to enter into a lawful marriage alliance under applicable laws.
You also confirm that you intend to use Byoli and its services to seek a life partner and not use it for casual dating or commercial purposes or for any other purpose whatsoever.
Byoli (in its sole discretion) reserves the right to suspend your membership and/or your right to use the Service without any refund to you of any of your subscription fees if it suspects that you are ineligible to become a member or if you have submitted fake misinterpreted details.

Registration:

It is very crucial that you complete your online registration with complete fairness and honesty and must enter accurate information with recent photographs that will help you to get matches.
Inaccurate Information, Incomplete details, and False or forged documents including morphed photos will result in immediate disqualification of your profile and may result in termination of your membership.
Creating duplicate profiles of the same person is prohibited. Byoli reserves the right to suspend & remove all such profiles without notice to you.
Only an individual (for personal use) can register and avail the services of Byoli.com, no businesses, companies or individuals running competitive businesses can become a member and use our services for commercial purposes. Byoli reserves the right to take legal action against any such individuals or entities.

Security:

You are solely responsible for maintaining the confidentiality of your Login Credentials, such as your User ID, Password, OTP, and more.
You must restrict any access to your computer/mobile device to prevent unauthorised access to your account.
Our representatives will never request passwords, and you are advised not to share your password with anyone.
The exchange of matrimonial profile(s) through the Platform should not in any way be interpreted as a matrimonial offer and/or recommendation from or by the platform.
Under no circumstance, Byoli shall be responsible for any loss or damage resulting from anyone's use of the Platform or its services and/or any content posted on the Platform.
Byoli will not be liable for any loss or damage suffered by any individual as a result of or following matrimonial relationships formed as a result of using its services.
You hereby agree to accept all responsibility for any actions taken under your account.

Byoli displays and shares your information with other registered members on “as is as available” basis after you register yourself on the platform.
Byoli reserves the right to authenticate the content posted on the platform by asking the user(s) to provide documents or other forms of evidence supporting the information.The user(s) must provide the same without any protest. Failure to do so within a reasonable or stipulated time frame shall result in the termination of the profile and access to the platform.
The profile(s) shown on the platform are automatically generated based on the preferences selected by you and cannot guarantee any specific results.
Every registered user of the platform can send interest to anyone and can communicate with them based on their preferences. The user has the liberty to accept or reject any interest(s) as per their choice.
Though Byoli uses the highest security standards and authentication mechanisms and has top-notch user safety features on the platform, Byoli still cannot guarantee complete protection of user data against tampering by any third party or person with miscellaneous intent.
User(s) must verify the information and credentials provided by other users of the platform in order to make informed decisions for a match, as Byoli cannot completely authenticate or endorse any user information shown on the platform.
As a member, it will be your responsibility to safeguard your user profile by creating a strong password while registering on the platform.
Byoli asks User(s) to share their health status during the registration process, this requires the user(s) to share if they have any pre-existing illness/disease, physical disability etc. Non-disclosure of such information will be termed as a violation of the terms and conditions.
To ensure safety and a positive user experience, all members must refrain from getting into financial transactions with other members, sharing confidential information like bank details, using abusive language while communicating, being discriminative or using racial comments, entering into physical relationships before marriage, asking for other matrimonial services. Byoli reserves the right to protect the platform and its users against any such event as it deems appropriate in its sole discretion without notice to you.
User(s) must be cautious of matches who ask for financial favours, call from different numbers, avoid face-to-face meetings (personally or on Video calls), do not involve family members, and have incomplete or conflicting information on their profiles.
Byoli reserves the right to remove/delete any content/profile/subscription of a User based on a complaint filed by another user or upon discovery by Byoli.
User(s) will be solely responsible for any conversation/passing of information etc. with another user(s) via e-mail, chat, telephone etc. and Byoli has no obligation to monitor such conversations or resolve disputes arising between the users.
Byoli reserves the right to censor any objectionable communications/advertisements that you may send to other user(s) by deleting any such communications/advertisements at any time at its sole discretion
Byoli reserves the right to take proper legal action against the user(s) who violates or misuses or poses any threat to other members of the platform.
User(s) might receive important notifications & promotional content from Byoli in the form of E-mail, SMS, WhatsApp Messages, Calls, Push notifications and more. User(s) while registering on the platform are consenting to receiving such notifications from time to time.
Byoli reserves the right to add/alter/modify/suspend/delete any or all services that it offers as it may deem fit, with or without prior notice to you.
You hereby agree to all the above terms and agree to provide only genuine information about yourself and help Byoli in making this platform safe for all its users. Failure to do so might/will result in termination of your membership.

Content Policy

By sharing your information with Byoli you grant your consent to store, use, distribute, reproduce, modify, adapt and publicly display such information on the platform and to its members.
You agree and understand that all information including text, photos, graphics and communications that is either publicly or privately available on the platform are the sole responsibility of the user(s) from whom such information is originated.
You also agree and understand that Byoli cannot fully control the content and information posted by its members, and hence cannot guarantee the accuracy, integrity or quality of such Content or information.
It is advisable to all the users to independently verify the content and information posted by other members before making decisions to act upon them. Byoli under no circumstances will be liable for any loss or damage of any kind incurred as a result of the use of such content and information.
Following is the list of the kind of content or information that is completely prohibited as well as illegal to post on the platform. Byoli reserves the right to take any legal action including removing the offending content or information and terminating the membership of the User without a refund. Prohibited content is the content:

That is offensive to the community, that promotes hatred, bigotry, racism, and physical threat of any kind against any group or individual(s).
Harasses or promotes harrasment.
Includes chain letters, spam mail etc.
Contains false information, misleading, abusive, obscene or defamatory.
Restricted information like passwords, financial details etc.
Displays sexually explicit material like porn.
Unsuitable for minors (below the age of 18 Years).
Exploits minors (below the age of 18 Years) in a sexual or violent manner.
Provides instructions about illegal activities like buying drugs, buying or making weapons, compromising with someone's privacy & more.
Threatens the integrity, security, unity or sovereignty of India.
Promotes someone’s copyrighted work.
Impersonate any other person.
Contains computer code, viruses or program designed to compromise or destroy the functionality of any computer resource.

Use of copyrighted material, such as trademarks and proprietary information is completely prohibited. User(s) cannot post, distribute, or reproduce any such copyrighted material without the prior written permission of the copyright owner.
Similarly, Byoli owns and retains the proprietary rights of this platform that includes trademarks, and other proprietary information, except for the information which is available in the public domain.
If you believe that your work has been copied and posted on Byoli in a way that constitutes copyright infringement, please reach out to our customer service to register a complaint.
Similarly, if it is suspected, that the User has, in any way, violated the rules of copyright infringement. Byoli reserves the right to take appropriate legal action against the said user(s).

Third-Party Websites

Byoli may allow third parties to display advertisements on the platform and cannot control the contents of such third-party advertisements.
Such third parties are governed by their own terms and conditions for use and privacy. In case of any conflict, terms and conditions of the third-party website shall be applicable
Byoli in any manner, does not authenticate, endorse, verify or certify these third-party websites or their contents.

Limitation on Liability

You agree and understand that Byoli and its affiliates shall under no circumstances be liable or responsible for any direct, indirect, exemplary, incidental, or consequential damages of any kind including, without limitation, damages resulting from the use of this Platform/Services/Third Party Website to any User(s) or Registrant(s) or any third party.
The exchange of profile(s) through or by this platform should not in any way be construed as a marriage proposal and/or recommendation and/or guarantee given to the user(s) by/from Byoli.
Byoli’s liability to the user(s) for anything contrary contained herein, for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by the User(s) to Byoli for any specific paid package, and no further.
Byoli will not be liable for any wrong/improper match, financial transaction between members, and/or for any member not responding/reciprocating when you approach them for matrimonial alliance.

Disputes

The user(s) is/are solely responsible for any communications (through any medium) with other Byoli member(s).
Byoli reserves the right but has no obligation to monitor or address disputes between members.
Byoli does not participate in the exchange of any kind of discussion between Byoli members and prospects or the results of their discussion.
However, Byoli reserves the right to take appropriate action against misbehaving members but is not obliged to share such action with other members, including the complainants.

Jurisdiction

For any dispute involving the Platform and/or its Services you unconditionally agree that all such disputes will be governed by the laws of India and shall be subject to the exclusive jurisdiction of the Competent Courts in Dehradun, India only.

Indemnity

By using this Platform, you agree to defend, indemnify, and hold harmless Byoli, its subsidiaries, affiliates, Directors, officers, agents, and other partners and employees from any loss, damage, liability, claim, or demand, including reasonable attorney's fees, made by any person as a result of improper use of our services. This defence and indemnification obligation will last forever.

Disclaimers

Byoli will not be liable for any loss or damage caused by anyone's use of the Site or the Service, or any Content posted on the platform or transmitted to its Members. You should not offer financial information (such as credit card or bank account information) to other Members, nor should you wire or otherwise pay money to them.
The exchange of matchmaking profile(s) through or by "Byoli" is in no way a marriage offer and/or recommendation from/by Byoli. Byoli shall not be liable for any loss or damage suffered by any individual as a result of or following any relations (including but not limited to matrimonial relations) formed as a result of using the Byoli service.
Byoli accepts no responsibility or liability for any illegal Content submitted by Members, users, or any other party on the Platform.
The Platform and Service(s) are offered on an "AS-IS" basis, and Byoli expressly disclaims any warranty of merchantability or non-infringement. Byoli cannot and does not guarantee or promise any specific results from the use of the Platform and/or its Service. You acknowledge that Byoli provides no express or implied warranties about compatibility with anyone you meet through the Service(s).
